MEMORANDUM FOR :
DEPUTY UNDER SECRETARY OF THE ARMY SUBJECT : Congressional Reporting Requirement to Forecast Excess Defense Articles (EDA) (DSCA 02-38 REFERENCE :
Reference (a), enacted on 30 September 2002, amends section 25 of the Arms Export Control Act (AECA) to require that the annual "Javits report" of possible arms transfers for the coming year include a list and amount of significant military equipment that the Military Departments (MILDEPs) believe are likely to become available for transfer as EDA during the next 12 months. To comply with this legislation, the Security Assistance Management Manual (SAMM) paragraphs 80303A and 80303B are deleted in their entirety and replaced as follows:
To meet the legislative requirement of reference (a), DSCA requests that each MILDEP forward a list of EDA, which is significant military equipment (type and quantity) presently available or forecasted to become available during calendar year 2003. Request that the MILDEPs provide a suggested list of recipients to receive articles. This list can be based on EOA surveys. A sample format for submission of this data, along with examples, has been attached to this memorandum-and is available electronically if requested. The MILDEPs' responses to reference (b), which also required the forecasting of ED A items, may serve as a reference. Your assistance with this request is appreciated.
