ENDP does not constitute approval of a transfer, which is a

State authority.

DoD can act unilaterally to approve an exception, but to do

so risks false impression that the eventual transfer would be

approved.

State’s NDPC concerns center on ensuring that exceptions

are approved only when there is a reasonable likelihood that

State would also approve the eventual transfer of the article

or service.
